General Conditions of Sale (GCS)
Article 1 – Champ d’application
Les présentes Conditions Générales de Vente (CGV) régissent les relations entre Confluence Pérou et ses clients dans le cadre de ses trois activités : (1) conseils en itinéraire, (2) promotion touristique et (3) vente en ligne de produits péruviens authentiques. Toute commande ou utilisation des services implique l’acceptation sans réserve des présentes CGV.
Article 2 – Itinerary Consulting Activity
Confluence Peru offers a consulting service for the design of personalized itineraries.
- Confluence Peru does not make any reservations (accommodation, transportation, activities, etc.).
- Confluence Pérou cannot be held responsible for any hazards that may occur during the trip (delays, cancellations, incidents, weather conditions, health problems, etc.).
- The responsibility for the trip lies entirely with the client, who assumes the management of their reservations and final decisions.
- The customer acknowledges that the recommendations provided are purely indicative and do not constitute a guarantee of availability or quality of the services mentioned.
- Confluence Peru declines all responsibility in the event of changes in local conditions (health restrictions, political events, price changes, etc.).
Article 3 – Tourist Promotion Activity
Confluence ensures the promotion of local agencies and Peruvian tourism service providers.
- Confluence Peru is not a travel agency or a tourism agency but a company dedicated to promoting the authenticity and cultural richness of Peru through events, authentic products and consulting services. Confluence Peru only promotes activities offered by trusted local agencies, but does not intervene in the sales or contracting process.
- Confluence is in no way a party to contracts concluded between clients and local agencies.
- Any reservation or contractual commitment is made directly with the local agency concerned.
- Confluence cannot be held responsible for the services provided by partner agencies.
- The client acknowledges that Confluence acts only as an information intermediary and that no guarantee is given on the quality or execution of the services of local agencies.
Article 4 – Online Store of Authentic Peruvian Products
4.1 Products
- The products sold on the online store are selected for their authenticity and quality.
- The photographs and descriptions are provided for information purposes only and have no contractual value.
- Product availability may vary depending on inventory and suppliers.
4.2 Orders and Payment
- All orders are firm and final once payment has been validated.
- Payment is made via the secure means offered on the platform.
- Confluence reserves the right to cancel any order in the event of suspected fraud or non-compliance with payment terms.
4.3 Delivery
- Delivery times are indicative and may vary depending on logistical conditions.
- Confluence cannot be held responsible for delays or losses caused by carriers.
- The risk of loss or deterioration of the products is transferred to the customer upon their shipment.
4.4 Right of Withdrawal
- In accordance with current regulations, customers have 14 days from receipt of the product to exercise their right of withdrawal, except for personalized or perishable products.
- Return costs are the responsibility of the customer.
- Any returned product must be in its original condition and accompanied by its original packaging.
4.5 Warranty and Liability
- Confluence undertakes to provide products that conform to their description.
- In the event of a defective product, the customer can request a refund or exchange under the conditions provided.
- Confluence cannot be held responsible for indirect damages linked to the use of the products sold.
Article 5 – Force Majeure
Confluence cannot be held responsible in the event of inability to perform its obligations due to a case of force majeure (natural disaster, strike, health crisis, war, political unrest, etc.).
Article 6 – Personal Data
The information collected is processed in accordance with current regulations on the protection of personal data.
- Customer data will only be used for order processing and service improvement.
- The customer has the right to access, rectify and delete their personal data upon simple request.
Article 7 – Applicable Law and Disputes
Les présentes CGV sont soumises au droit français. En cas de litige, une solution amiable sera recherchée avant toute action en justice.
En cas de désaccord persistant, les tribunaux compétents seront ceux du siège social de Confluence.
Article 8 – Acceptance of the General Conditions of Sale
En validant une commande ou en utilisant les services de Confluence, le client reconnaît avoir pris connaissance et accepte les présentes CGV sans réserve.
Aucune dérogation aux présentes CGV ne sera acceptée sans accord écrit de Confluence.
