General Conditions of Sale (GCS)<\/h1>

Article 1 \u2013 Champ d\u2019application<\/h2>

Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales de Vente (CGV) r\u00e9gissent les relations entre Confluence P\u00e9rou et ses clients dans le cadre de ses trois activit\u00e9s :\u00a0(1) conseils en itin\u00e9raire,\u00a0<\/span>(2) promotion touristique et (3) vente en ligne de produits p\u00e9ruviens authentiques. Toute commande ou utilisation des services implique l’acceptation sans r\u00e9serve des pr\u00e9sentes CGV.<\/span><\/p>

Article 2 \u2013 Itinerary Consulting Activity<\/h2>

Confluence Peru offers a consulting service for the design of personalized itineraries.<\/p>

  • Confluence Peru does not make any reservations (accommodation, transportation, activities, etc.).<\/li>
  • Confluence P\u00e9rou cannot be held responsible for any hazards that may occur during the trip (delays, cancellations, incidents, weather conditions, health problems, etc.).<\/li>
  • The responsibility for the trip lies entirely with the client, who assumes the management of their reservations and final decisions.<\/li>
  • The customer acknowledges that the recommendations provided are purely indicative and do not constitute a guarantee of availability or quality of the services mentioned.<\/li>
  • Confluence Peru declines all responsibility in the event of changes in local conditions (health restrictions, political events, price changes, etc.).<\/li><\/ul>

    Article 3 \u2013 Tourist Promotion Activity<\/h2>

    Confluence ensures the promotion of local agencies and Peruvian tourism service providers.<\/p>

    • Confluence Peru is not a travel agency or a tourism agency but a company dedicated to promoting the authenticity and cultural richness of Peru through events, authentic products and consulting services. Confluence Peru only promotes activities offered by trusted local agencies, but does not intervene in the sales or contracting process.<\/li>
    • Confluence is in no way a party to contracts concluded between clients and local agencies.<\/li>
    • Any reservation or contractual commitment is made directly with the local agency concerned.<\/li>
    • Confluence cannot be held responsible for the services provided by partner agencies.<\/li>
    • The client acknowledges that Confluence acts only as an information intermediary and that no guarantee is given on the quality or execution of the services of local agencies.<\/li><\/ul>

      Article 4 \u2013 Online Store of Authentic Peruvian Products<\/h2>

      4.1 Products<\/h3>
      • The products sold on the online store are selected for their authenticity and quality.<\/li>
      • The photographs and descriptions are provided for information purposes only and have no contractual value.<\/li>
      • Product availability may vary depending on inventory and suppliers.<\/li><\/ul>

        4.2 Orders and Payment<\/h3>
        • All orders are firm and final once payment has been validated.<\/li>
        • Payment is made via the secure means offered on the platform.<\/li>
        • Confluence reserves the right to cancel any order in the event of suspected fraud or non-compliance with payment terms.<\/li><\/ul>

          4.3 Delivery<\/h3>
          • Delivery times are indicative and may vary depending on logistical conditions.<\/li>
          • Confluence cannot be held responsible for delays or losses caused by carriers.<\/li>
          • The risk of loss or deterioration of the products is transferred to the customer upon their shipment.<\/li><\/ul>

            4.4 Right of Withdrawal<\/h3>
            • In accordance with current regulations, customers have 14 days from receipt of the product to exercise their right of withdrawal, except for personalized or perishable products.<\/li>
            • Return costs are the responsibility of the customer.<\/li>
            • Any returned product must be in its original condition and accompanied by its original packaging.<\/li><\/ul>

              4.5 Warranty and Liability<\/h3>
              • Confluence undertakes to provide products that conform to their description.<\/li>
              • In the event of a defective product, the customer can request a refund or exchange under the conditions provided.<\/li>
              • Confluence cannot be held responsible for indirect damages linked to the use of the products sold.<\/li><\/ul>

                Article 5 \u2013 Force Majeure<\/h2>

                Confluence cannot be held responsible in the event of inability to perform its obligations due to a case of force majeure (natural disaster, strike, health crisis, war, political unrest, etc.).<\/p>

                Article 6 \u2013 Personal Data<\/h2>

                The information collected is processed in accordance with current regulations on the protection of personal data.<\/p>

                • Customer data will only be used for order processing and service improvement.<\/li>
                • The customer has the right to access, rectify and delete their personal data upon simple request.<\/li><\/ul>

                  Article 7 \u2013 Applicable Law and Disputes<\/h2>

                  Les pr\u00e9sentes CGV sont soumises au droit fran\u00e7ais. En cas de litige, une solution amiable sera recherch\u00e9e avant toute action en justice.<\/p>

                  En cas de d\u00e9saccord persistant, les tribunaux comp\u00e9tents seront ceux du si\u00e8ge social de Confluence.<\/p>

                  Article 8 \u2013 Acceptance of the General Conditions of Sale<\/h2>

                  En validant une commande ou en utilisant les services de Confluence, le client reconna\u00eet avoir pris connaissance et accepte les pr\u00e9sentes CGV sans r\u00e9serve.<\/p>
